Construction Design and Management Regulations 1996 and Health and Safety mattersThe need for a Planning SupervisorThe CDM Regulations imposes a requirement for the client (building owner or tenant) to employ a Planning Supervisor to administer the regulations with regard to health and safety matters in the design of building works and on the building site. It should be noted that this is a requirement and not a recommendation and it is a criminal offence to break this law. The Planning Supervisor may be the same or different person or firm as the designer. He/she is required to consider all the potential dangers imposed by the intended design and construction contract and to prepare a Health and Safety Plan prior to tender stage identifying all the dangers. The Planning Supervisor ensures that the various parties properly assess the dangers and, at the end of the contract, ensures that a Health and Safety File is prepared recording the work carried out and the maintenance requirements, especially in respect of health and safety matters.
