Services for the Legal ProfessionBrian Eyley Partnership (B E P) provides a number of services which are of particular interest to Solicitors, other members of the legal profession and to their clients, including Expert Witness work, Dilapidations claims, schedules of condition and condition surveys.DilapidationsActing for the Lessor, Schedules of Dilapidation are prepared and priced for serving on the Lessee by the Solicitor. Later, the work carried out by the Lessee is checked, or alternatively the amount of damage negotiated with the Lessee's representative. If necessary, a Specification of Works can be prepared, tenders obtained and the repair works undertaken under our control. Acting for the Lessee, a check is made on the Lessor's schedule to ensure
that there are no spurious claims and to identify high costs capable of reduction.
Negotiations are carried out with the Lessor's In cases of disagreement or matters of law, we like to work as a team with the Solicitor and, if matters are not resolved we give evidence in Court or at an Arbitration. Schedules of ConditionA schedule detailing the condition of a building at the commencement of the lease is prepared in detail to avoid future disagreements. Again, we liaise closely with the Solicitor involved to ensure that the content of the Schedule is appropriate considering the repairing covenants of the lease. Condition SurveysNon residentialWe undertake condition surveys of all building types and sizes including major commercial, industrial and retail premises. Investigations of major defects can also be undertaken liaising with specialist or testing laboratories as required. Reports can be provided for many different purposes including condition assessment prior to purchase or lease, major defect investigation, litigation or to support a feasibility study to establish alternative future uses. ResidentialStructural surveys of dwelling houses and other residential buildings are be undertaken. Charities and Housing AssociationsFeasibility studies for purchase, rehabilitation, conversion or redevelopment are undertaken. Subsequent work can include the design, specification and monitoring of the building works in accordance with the Housing Corporation's requirements or other similar advice. Building LitigationBrian Eyley acts as an expert witness in building litigation cases. Construction defects are investigated and analysed for material and workmanship defects, any necessary specialist tests are arranged, remedial works specified and costs assessed. Often, the repairs are implemented under his control. He is also able to assist with the preparation of Scott Schedules and will prepare reports and Proofs of Evidence as needed. Expert Evidence can be given in court if the matter is not settled in the preliminary stages.
